
The following General Terms and Conditions apply to the booking and execution of travel services between LKHAM GUA LLC, hereinafter referred to as “LKHAM GUA”, and the client, hereinafter referred to as the “traveler”, unless otherwise agreed.
GENERAL TERMS & CONDITIONS (GTC) for Travel Bookings via www.silkroadmongolia.mn
These General Terms and Conditions apply to all business relationships between LKHAM GUA and customers purchasing services via the online platform silkroadmongolia.mn, as well as all other services, in the version valid at the time of booking.
By booking through silkroadmongolia.mn or purchasing travel services via info@silkroadmongolia.mn, you agree to these Terms & Conditions. Please read them carefully before making any prepayment and/or full payment.
1.Registration; Booking Confirmation
By registering, the client offers to enter into a travel contract with LKHAM GUA. Upon acceptance—without any specific form required—the contract becomes binding for both parties.
Once the contract is concluded, or immediately thereafter, LKHAM GUA will send a written booking confirmation by email. If there are discrepancies between the confirmation and the booking request, they will be clearly stated. LKHAM GUA is bound by this revised offer for 7 days. The contract becomes valid if the client accepts within this period.
Bookings are available for persons aged 12 and above. For minors, a legal guardian must assume full responsibility, including liability for damages or injuries.
2. Payment; Travel Documents
2.1 Payments prior to the end of the trip may only be requested upon provision of a risk coverage certificate. This also applies to deposits.
2.2 After receiving the booking confirmation and invoice, a deposit is required. The amount varies depending on the tour type and is specified in the pricing section. The full balance must be paid 60 days before departure. Payments are valid only when received by LKHAM GUA LLC.
2.3 For credit card payments, the amount will be automatically charged on the specified dates.
2.4 If payments are not made on time, LKHAM GUA reserves the right to cancel the contract after notice and charge cancellation fees as outlined in Section 4.
3. Changes to Services and Prices Before Travel
3.1 Changes to essential characteristics of the travel services compared to what was agreed in the travel contract, which become necessary after the conclusion of the contract and were not caused by us intentionally, are permitted before the start of the trip, provided that such changes are minor and do not affect the overall nature of the trip.
3.2 LKHAM GUA LLC must inform the traveler of any changes to services immediately after becoming aware of the need for modification. This notification will be provided via a durable medium, such as email, in a clear, understandable, and precise manner.
3.3 In the event of a significant change to an essential element of the trip or to specific requirements that form part of the travel contract, you will be granted a reasonable period—set by us—after being notified of the change to:
You may choose to respond or not to our notification. If no response is received, or if your response is late, the notified change will be considered accepted. This will be clearly indicated in our communication in accordance with section 3.2.
Otherwise, you may either accept the contract modification, request to join an alternative trip (if offered), or terminate the contract free of charge.
4.Cancellation by the Client Before the Start of the Trip / Cancellation Fees
4.1 The client may withdraw up until the start of the trip. If the client cancels the trip or fails to show up, they must pay compensation to LKHAM GUA LLC. The amount of compensation is calculated based on the agreed trip price, minus any cost savings and benefits LKHAM GUA LLC gains from the participation of third parties.
4.2 In the event of withdrawal before the trip starts or if the trip does not take place, we may claim compensation if the cancellation is not our fault or if exceptional circumstances occur at or near the destination that prevent the trip or transport from taking place; or if unforeseeable circumstances beyond our control occur, and their consequences could not have been avoided despite taking all necessary precautions.
4.3 LKHAM GUA LLC is entitled to demand compensation in the form of a flat rate. The compensation amount is calculated based on the trip price. Any savings the organizer makes, as well as payments obtained from other uses of travel services, are deducted.
Applicable Cancellation Conditions for All Trips:
4.4 We have set a flat-rate compensation based on the time between the cancellation notice and the start of the trip. We also consider anticipated cost savings and the likelihood that other clients will purchase the trip. Upon request, LKHAM GUA LLC must justify the compensation amount. Please refer to Section 13 of these travel conditions for single-payment compensation details.
4.5 If we are required to refund the trip price due to a withdrawal, payment will be made within 14 days of receiving the withdrawal notice.
4.6 LKHAM GUA LLC cannot claim compensation if unavoidable and extraordinary circumstances occur at or near the destination that significantly affect the trip or transportation to the destination. Circumstances are considered unavoidable and extraordinary if they are beyond the control of the party invoking them and their consequences could not have been avoided even with all reasonable precautions. In such cases, both LKHAM GUA LLC and the traveler have the right to cancel. LKHAM GUA LLC will refund the trip price within 14 days of cancellation.
5. New Booking / New Clients
5.1 After the contract is concluded, no rights exist to change the travel conditions, including dates, destination, departure location, accommodation, or mode of transport (new booking). If a modification is agreed upon, the traveler must bear any additional costs, which will be communicated at the time of modification. The above provisions do not apply if the modification is necessary because we did not provide sufficient or correct pre-contractual information; in that case, the modification is free of charge.
6.Termination of Contract for Behavioral Reasons
LKHAM GUA may withdraw from or terminate the travel contract without prior notice after the start of the trip if the traveler disrupts the proper execution of the trip despite prior warnings, or if their behavior violates the contract to such an extent that immediate termination is justified.
This does not apply if the breach of contract is caused by LKHAM GUA’s own failure to fulfill its information obligations.
In the event of termination by LKHAM GUA LLC, we retain the right to the agreed travel price. However, we must deduct the value of any expenses saved, as well as any benefits gained from reallocating the services to another party, including any refunds received from service providers.
7.Traveler’s Duty to Cooperate
7.1 Please inform us in a timely manner, or notify the travel agency through which you booked the travel services, if you have not received the required travel documents by the specified date.
7.2 Notification of Defects / Claim for Compensation
If the trip is not provided without defects, the traveler may request compensation from our local representative or from LKHAM GUA LLC. Your cooperation is required for this, regardless of our primary performance obligation. You are therefore obliged to do everything reasonably possible to help correct the error and to keep any damage as low as possible, or to prevent it entirely. If LKHAM GUA LLC was unable to remedy the situation due to the traveler’s failure to report the defect, the traveler cannot claim a price reduction.
7.3 Deadline Before Termination
For this reason, the travel contract can only be terminated due to a significant defect in the trip, provided that the traveler has previously set a reasonable period for remedy. This does not apply if LKHAM GUA LLC refuses to provide a solution or if an immediate solution is required.
8. Limitation of Liability
8.1 LKHAM GUA LLC is not responsible for service disruptions, bodily injury, or property damage related to travel services that are offered solely as third-party services (e.g., organized excursions, sporting events, theatrical performances, exhibitions), provided that these services are explicitly mentioned in the travel announcement and in the travel confirmation, indicating the identity and address of the intermediary contractual partner, clearly marked as external services so that you cannot recognize them as part of our travel services, and selected separately. However, we are responsible if and to the extent that your damage was caused by a failure in our duty to provide information and/or organize the service.
9.Asserting Your Rights: Address and Consumer Dispute Information
9.1 You must assert claims regarding defects directly with LKHAM GUA LLC. Claims can also be made through the travel agency if the travel services were booked through them. It is recommended to assert your rights in a permanent data format.
9.2 We emphasize that we do not participate in voluntary consumer dispute resolution.
10.Traveler Protection (Trip Cancellation Insurance, etc.)
We would like to draw your attention to the fact that, in certain cases of cancellation (for example, in the event of unforeseen illness before departure), you may take out travel cancellation insurance and travel interruption insurance.
We also strongly recommend that you obtain insurance covering assistance costs, including repatriation, in the event of an accident, illness, or death.
11.Data Protection
When you make a booking, we collect the personal data necessary for the conclusion of the travel contract. This data is stored electronically, processed, and—where necessary for the execution of the contract—shared with third parties, such as service providers including hotels and airlines.
12. Compensation for Single Payment (cf. Sections 4.2 and 4.3)
The respective amount of compensation fees depends on the travel service selected and the time at which you received our cancellation notice.If you have paid for multiple travel services individually (e.g., flights and round-trip travel), the compensation must be calculated separately using the flat rates indicated below and then added together. Please note that any deviations specified in the offers of the individual travel services shall take precedence.
